BiG Energy & Electric — Terms & Conditions


Energy Storage Systems Our energy storage systems are designed as whole-home backup solutions. Under typical operating conditions and average residential load profiles, a fully charged system is estimated to provide a minimum of 18 hours of backup power. Actual runtime will vary depending on real-time energy consumption, large appliance usage (such as HVAC, electric heating, and EV charging), and the battery state of charge at the time of an outage. As a whole-home system, all circuits connected to the main 200-amp service panel are capable of being powered during an outage, subject to load management and system capacity limits.

Solar Photovoltaic (PV) Systems Solar PV systems are designed based on site-specific conditions including roof orientation, pitch, shading analysis, available square footage, and the Customer's average energy consumption. System sizing estimates and projected energy production figures provided in any quote or proposal are based on industry-standard modeling tools and good-faith assumptions. Actual energy production will vary depending on weather conditions, seasonal sunlight availability, shading from trees or structures, soiling of panels, and other environmental factors. BiG Energy does not guarantee specific energy production levels or utility bill savings. Any production estimates provided are for illustrative purposes only and do not constitute a warranty or guarantee of performance.

For ground-mount and vertical-mount solar installations, the Customer is responsible for ensuring that the proposed installation area is free of underground utilities, easements, deed restrictions, or HOA limitations that may prohibit or restrict installation. BiG Energy is not liable for delays or costs arising from site conditions not disclosed at the time of contract execution.

For roof-mounted solar installations, the Customer represents that their roof is in adequate condition to support the installation. BiG Energy is not responsible for any pre-existing roof defects, leaks, or structural issues. If a roof inspection reveals that the existing roof is not suitable for installation, BiG Energy reserves the right to require remediation before proceeding or to adjust the scope of work, which may result in a revised quote.

Installation Timeline The estimated timeline from contract execution to completed installation is approximately 2–6 months. Solar projects may require additional time depending on system complexity, roof or ground conditions, structural engineering requirements, and utility interconnection timelines. This schedule is a good-faith estimate only and is subject to permitting, State program approvals (e.g., NYSERDA), utility interconnection review, equipment availability, and site readiness. Delays caused by utility processing, program requirements, permitting authorities, supply chain constraints, weather, or other factors beyond the Contractor's control may extend this timeline. A target installation window will be confirmed upon invoice issuance.

Financial Incentives & Tax Credits

Federal Tax Credits Discounts, rebates, and credits may be available to homeowners following the installation of approved products, including solar PV systems and energy storage systems, in accordance with applicable program guidelines. Eligibility and final credit amounts are determined by individual circumstances, including tax liability and system qualification. We recommend consulting a qualified tax professional or accountant to confirm eligibility and to understand how any credit applies to your specific situation. Please note that rebates and discounts are only available for systems approved within stated program timeframes and prior to any applicable expiration dates.

Net Metering & Utility Compensation Solar customers may be eligible to participate in their utility's net metering program, which allows excess electricity generated by a solar PV system to be credited against the Customer's utility bill. Net metering eligibility, credit rates, and program rules are established and governed by the Customer's utility company and applicable state regulations, and are subject to change. BiG Energy does not guarantee the continued availability of any net metering program or the value of any credits received. It is the Customer's responsibility to confirm net metering eligibility with their utility provider prior to contract execution.

Green Bank Program Incentive DisclaimerAll Green Bank program incentive figures provided are estimates and are subject to final approvals by the proream. Final incentive amounts will be determined upon formal program application and approval. Active Dispatch Performance Incentives may vary significantly based on factors including battery degradation, discharge limitations imposed by the battery manufacturer or operator, customer opt-out, weather events, and overall system design. Estimate projections assume an annual battery degradation rate of 2.5%, an 80% depth of discharge, a 75% participation rate, and an average event duration of 2.5 hours over the ten-year enrollment term. BigEnergy USA makes no guarantee of specific incentive amounts, and customers are encouraged to consult program documentation for complete details.

NYSERDA Incentives Customers may be eligible for incentives through NYSERDA's  program or other applicable state-sponsored solar programs. Incentive amounts are determined by program guidelines and are subject to availability, funding caps, and expiration. BiG Energy will assist with program applications where included in the agreed scope of work; however, final incentive determinations are made by the administering program and are not within BiG Energy's control.

HELOC Interest Deductibility Interest paid on a Home Equity Line of Credit (HELOC) may be tax-deductible when the borrowed funds are used to substantially improve the homeowner's primary residence, such as installing solar, energy storage, or other resilience upgrades. Under current IRS guidelines, deductible interest is generally limited to qualified home improvement uses and is subject to applicable loan limits and individual tax circumstances. Homeowners should consult a tax professional to confirm eligibility.

Capital Improvement Sales Tax Exemption If the project qualifies and is approved as a capital improvement under applicable tax laws — including solar PV installations, which may qualify as capital improvements under New York State law — the property owner may be eligible to complete and submit the required Capital Improvement forms to assist in reducing or eliminating applicable sales taxes. It is the sole responsibility of the property owner to determine eligibility and ensure all necessary documentation is properly completed and submitted. We recommend consulting a tax professional for guidance specific to your situation.

Permitting Permitting services are offered separately and may be provided by our company for an additional fee. Solar installations typically require electrical permits, building permits, and utility interconnection applications, and may require structural engineering sign-off depending on local jurisdiction requirements. If permitting services are not included in this agreement, it is the sole responsibility of the Customer to ensure that all necessary permits are obtained, in place, and completed in accordance with all applicable laws and regulations. BiG Energy assumes no responsibility or liability for permits not secured by the Customer. If your project requires a minimum panel upgrade or the installation of an outdoor meter disconnect due to electrical code requirements or utility company guidelines, these costs are not included in this proposal. Such upgrades are considered additional work and will be quoted separately upon determination of need.

Utility Interconnection For solar PV systems, utility interconnection approval is required before the system may be energized and connected to the grid. BiG Energy will assist with the preparation and submission of interconnection applications where included in the agreed scope of work. However, the review, approval, and timeline for interconnection are solely within the control of the utility company. BiG Energy is not responsible for delays caused by utility interconnection processing times. The Customer acknowledges that the solar system may not be energized until formal interconnection approval is received from the utility, and that BiG Energy bears no liability for any delay in receiving such approval.

Quote Validity & Payment Terms This quote is valid for 14 days from the date of issue and is subject to change after that period. Prices are based on the specifications provided, and any changes to the scope of work may require a revised quote. A 60% deposit is required upon contract acceptance, with the remaining balance due upon project completion or per agreed milestones. Late payments may incur a 10% interest charge.

Site Responsibilities The Customer agrees to provide a clean, safe, and accessible work environment for all contractors and employees. This includes maintaining clear and unobstructed driveways for equipment and vehicle access, ensuring that all electrical circuits and panels are properly labeled for efficient identification, and addressing any hazardous conditions that may pose safety risks prior to the Contractor's arrival. For solar installations, the Customer is also responsible for ensuring roof access is unobstructed and that any required HOA, municipality, or landlord approvals are obtained prior to the scheduled installation date. In the event of delays caused by site inaccessibility, unsafe working conditions, lack of proper labeling, or failure to obtain required approvals, an additional travel charge of 5% of the total invoice amount may be applied to compensate for lost time and expenses incurred.

Warranties Materials and equipment are covered under the respective manufacturer's warranty. Solar panels and inverters are typically covered by separate manufacturer product and performance warranties, the terms of which will be provided to the Customer upon installation. Workmanship is warranted for two (2) years from the date of installation. Projects completed through NYSERDA programs are subject to a five (5) year warranty requirement, and projects completed through Green Bank programs are subject to a ten (10) year warranty requirement. This quote excludes unforeseen circumstances not identified at the time of contract execution.

Cancellations

Standard Cancellation Policy Cancellation of this agreement after acceptance may result in a cancellation fee of 20% of the total contract amount. The Contractor is not responsible for delays caused by force majeure events or permitting delays. Any changes to the terms of this agreement must be mutually agreed upon in writing by both parties.

3-Day Right to Cancel The Customer has the right to cancel this Agreement without penalty within three (3) business days of signing. To exercise this right, the Customer must provide written notice of cancellation to BiG Energy within the three-day period. If cancellation occurs within this timeframe, any payments made by the Customer will be refunded in full and no further obligations shall apply. After the three-day cancellation period has expired, this Agreement becomes fully binding and is subject to all terms and conditions stated herein.

Equipment Payment Plan Enrollment in the BiG Energy Equipment Payment Plan constitutes a binding agreement for the purchase, installation, and associated services related to the contracted energy equipment. This Payment Plan provides customers with a flexible month-to-month installment structure and includes enrollment in the BiG Energy Service Plan for the duration of the payment term, allowing customers to spread the remaining system cost over time while ensuring the equipment remains professionally monitored and maintained. This Payment Plan is not a cancel-at-will subscription. By enrolling, the Customer agrees to pay the full contract amount in accordance with the agreed payment schedule. Once equipment has been ordered, materials have been allocated, permits have been submitted, engineering has commenced, or installation work has begun, this agreement may not be cancelled without financial obligation. In the event of cancellation, default, or early termination after such project activities have commenced, the remaining unpaid balance of the contract shall become immediately due and payable. The Customer acknowledges that BiG Energy undertakes equipment procurement, engineering, permitting, scheduling of labor, and allocation of materials in reliance upon this agreement, which creates non-recoverable costs and contractual obligations. Upon full payment of the contract amount, ownership of the equipment vests fully in the Customer, and the month-to-month Service Plan may be cancelled or continued at the Customer's discretion.

Insurance & Liability The Contractor carries appropriate insurance coverage for all project work. Contractor liability is limited to the coverage limits of the applicable insurance policy. This quote excludes unforeseen circumstances not identified at the time of agreement. Completion time is subject to weather conditions, material availability, and unforeseen delays beyond the Contractor's control. BiG Energy is not liable for any damage to roofing, structural components, or property that results from pre-existing defects or conditions not disclosed or discoverable at the time of contract execution.

Regulatory Contact The New York State Department of Public Service (DPS) regulates utilities in New York State and may be contacted for complaints, questions, or additional information regarding electric, gas, steam, telecommunications, or water service, including matters related to net metering and utility interconnection for solar customers. The DPS is located at Empire State Plaza, Agency Building 3, Albany, NY 12223-1350. Consumers may also obtain assistance or file a complaint through the DPS website at dps.ny.gov.

For projects performed in the State of Connecticut, BiG Energy & Electric is a licensed Home Improvement Contractor registered with the Connecticut Department of Consumer Protection, HIC License No. 0704679. Customers in Connecticut may contact the Department of Consumer Protection with complaints or inquiries at: Connecticut Department of Consumer Protection, 450 Columbus Blvd., Suite 901, Hartford, CT 06103, or online at portal.ct.gov/DCP.

By proceeding with this agreement, the Customer acknowledges that they have read, understood, and agreed to these Terms & Conditions.
